You can lodge an objection against an enforcement order.

Prerequisite

An enforcement order has been issued against you and you do not agree with it because, for example, you believe that

  • The applicant is entitled to the claim
    • at all,
    • not in the amount claimed or
    • not at the present time.
  • The claimant is claiming from the wrong person.

Procedure

You must lodge an objection to the enforcement order with the court that issued the enforcement order:

  • in writing
  • electronically by a secure means of transmission (Section 130a ZPO) or
  • at the court registry for recording

Use the form attached to the enforcement order. The objection does not have to contain any reasons.

After you have lodged an objection, the court that issued the enforcement order will hand over the legal dispute to

  • the court designated as the competent court in the previous order for payment, or
  • another court if the parties agree that the case should be transferred to another court.

In the subsequent court proceedings, the court examines whether the claim is justified.

Deadlines

You must lodge the objection within two weeks from the date of service of the enforcement order. Notwithstanding this, a period of one week applies for filing an objection in labour court dunning proceedings.

Note: If you have lodged an objection to the order for payment late, the court will treat this as an objection to the enforcement order.

As part of the decision on the objection, the court also determines who is to bear the costs of the dunning procedure.
