If you wish to construct a new facility for handling substances that pose a risk to water, or to make significant alterations to an existing facility, or to take measures that result in a change to the risk level, you must notify the relevant authority.
You must submit your notification regarding the construction, substantial modification or change to the hazard level of a facility subject to inspection to the competent authority at least six weeks in advance.
A notification is not required if
- an application for a suitability assessment under the Water Resources Act has been submitted for the facility, or
- the installations are subject to an authorisation procedure under other legislation, provided that compliance with the requirements of this Regulation is also ensured as part of that authorisation procedure. This is generally the case for authorisations granted under the Baden-Württemberg State Building Regulations or the Federal Immission Control Act.

Responsible authority
Please ensure that you submit your notification to the relevant water authority.
The relevant regional councils (Regierungspräsidien) act as higher water authorities where the notification relates to premises on which at least one installation is present or planned,
- which is marked with the letter E in Annex 1, Column d, of the Ordinance on Installations Requiring Authorisation (4th BImSchV),
- which constitutes an operational area under Section 3(5a) of the Federal Immission Control Act (major-accident establishment),
- which requires authorisation under Section 60(3), first sentence, number 2 or 3 of the Water Resources Act, or
- which constitutes a landfill site under Article 10 in conjunction with Annex I of the EU Industrial Emissions Directive, as amended (landfill site of Class I or higher).
The State Mining Authority, Department 9 [Freiburg Regional Council] is responsible throughout the state for premises subject to mining supervision on which one of the above-mentioned installations is located or is to be constructed.
In all other cases:
- in a city district: the city administration,
- in a rural district: the District Office,
the competent lower water authority.

The installations must comply with the requirements of the Ordinance on Installations for the Handling of Substances Hazardous to Water (AwSV). This must be demonstrated by the documentation to be submitted.
Procedure
If you wish to submit the report online:
- You submit the notification via the online service.
- The relevant authority will check your documents to ensure they are complete and, if necessary, request any missing information or documents.
- In addition, the substantive requirements will be checked, which may also result in further requests for information.
- The authority may provisionally or permanently prohibit the project, or issue a decision imposing conditions.
If you wish to submit the notification by post or email:
- You must complete the forms required for the notification and send them to the relevant authority.
- The remaining steps in the procedure are the same as for the online procedure.

Costs
Fees are only payable if the competent authority is required to order additional measures. The basis for calculating the fees is the statutory order and the statutes of the relevant competent authority, as well as the provisions of the State Fees Act.
